INVESTIGATION AND REPORT:- How to PM Shri Narendra Modi is misleading the country about Mehul Choksi.
Prime Minister Shri Narendra Modi was aware of the PNB Scam before Mehul Choksi fled.
MATTER
Mehul Choksi gained notoriety for his involvement in the Punjab National Bank (PNB) scam, through which the public sector bank was defrauded of nearly Rs 13,500 crore. He is alleged to have masterminded the scam, with his nephew Nirav Modi also being accused.
The embezzlement of funds was only discovered in 2018, around 8 years after Gitanjali Gems, led by Choksi, began deceiving PNB. Since then, Choksi has fled the country and is currently considered a ‘wilful defaulter’, wanted by Indian authorities including the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI).
MODUS OPERANDI
The Gitanjali Group, a retail jewelry firm with around 4,000 stores in India, is at the center of the PNB scam. With the involvement of some staff members at the public sector bank, Choksi’s Gitanjali Gems initiated a series of transactions at PNB starting from 2011, which were not properly recorded in the bank’s Core Banking Software (CBS).
Around 165 Letters of Undertaking (LoUs) were fraudulently issued to Choksi’s companies. An LoU is a guarantee issued by a bank that allows the bank’s customer to raise short-term credit from a foreign branch of another Indian bank. The fraud occurred because no securities were kept in place before the LoUs were issued to Choksi’s companies.
Apart from the fraudulent Letters of Undertaking (LoUs), numerous Foreign Letters of Credit (FLC) were also issued, many of which were significantly overvalued. An FLC is a form of short-term credit used in international trade. Despite being not creditworthy, Choksi was still able to obtain funds through FLCs.
“Punjab National Bank (PNB) was not the only victim of Choksi’s payment defaults. Gitanjali Gems also defaulted on repayments for loans obtained from Life Insurance Corporation of India (LIC), ICICI Bank, and IDBI Bank. Additionally, Choksi’s jewelry business was found to have violated several rules of the Foreign Exchange Management Act (FEMA).”
REPORT :- The Whistleblower Shri Hari Prasad SV alerted PMO
On 26/07/2016, Whistleblower Shri Hari Prasad SV filed an official complaint on the Public Grievances Portal (PG Portal) with registration number PMOPG/E/2016/0261955 and date of receipt 26/07/2016.
Mehul Choksi, Chairman and MD of M/S Gitanjali Gems Lt., Mumbai is all set to flee from the country as he has already moved funds abroad in the name of his wife/son and daughters and made settlements in Dubai, USA and Belgium etc. If urgent action is not taken he will cause losses of apx Rs 10,000 Crores to various Indian PSU banks, Investors and other financial institutions. 100% chance that he will flee the country if the passport of this person is not seized immediately it will also end up like the Vijay Mallya case only. Hence Kindly take urgent action before it becomes too late.
INVESTIGATION
Afterwards, due to negligence in the Prime Minister’s Office and support from PM Shri Narendra Modi, Mehul Choksi and his nephew fled from India.
Choksi knew in advance that he would be caught. Before all the details of the PNB scam were revealed, Choksi and his family fled the country in January 2018, arriving in Antigua and Barbuda just days before PNB filed a formal complaint with the CBI.
Choksi had applied for citizenship in the Carribean country in May 2017 itself. This shows how the diamantaire had no intentions of repaying the loans and that fleeing after defaulting was a planned move.
India’s Government Authority / Agency Replies
We (HELPFUL FOUNDATION) filed the RTI to the concerned department of this matter and found that PMO didn’t forward this registration number PMOPG/E/2016/0261955, Date of receipt 26/07/2016 to any Authority and Agency for action against them.
1. Central Bureau of Investigation (CBI) Reply to Helpful Foundation:- In this connection, It is informed that as per records available in this office, the Information sought by you i.e., PMO Grievance Registration Number PMOPG/E/2016/0261955, has not been received in this office.
2. Registrar of Companies, Mumbai (RoC) Reply to Helpful Foundation:- As per information provided by the complaint cell of this office, as per available information the application is not traceable by this office.
3.Bureau of Immigration (BoI) , Ministry of Home Affairs Reply to Helpful Foundation:- Information is not available with us.
4.Ministry of Home Affairs Reply to Helpful Foundation:- As per the information available on the CPGRAMS portal, the Grievance registration number PMOPG/E/2016/0261955 has not received online in the Ministry of Home Affairs.
Why is the PMO responsible for Mehul Choksi fleeing from India?
The Whistleblower Shri Hari Prasad SV alerted PMO via PG Portal.
The PG Portal is a part of the Centralised Public Grievances Redress and Monitoring System (CPGRAMS). It serves as a platform for citizens to file grievances against government organizations and have them redressed promptly.
The grievance is sent to the relevant Ministry, Department, or State Government for immediate redress.
NOTE: In this case, the PMO did not send it to any ministry or any investigation agency for further action.
INTERPOL:- The removal of the Red Notice grants Choksi the freedom to travel anywhere in the world except India.
CONCLUSION
This matter falls under the Prevention of Corruption Act by PM Shri Narendra Modi due to the misuse of power, lack of integrity or honesty, and the use of a position of trust for dishonest gain.
Corruption is the misuse of power or authority for illegitimate or unethical purposes, often involving bribery and patronage.
