End User Agreement
By contributing to Helpful FOundation – NGO, You understand and agree to the following:
• You are entirely aware of the primary activities of Helpful Foundation, which include:
To address the private sector’s role in public sector governance and anti-corruption efforts and to support national efforts to reduce corruption.
To adopt and implement international anti-corruption instruments as well as the implementation of regional agreements.
To develop a speedy communication system using modern communication techniques to encourage quicker actions to protect human rights, redress wrongs, and prevent violations in the future.
To train young men and women to face the challenges of the pluralistic society and the rising conflicts and tensions in the name of particularistic loyalties to caste, religion, region, and culture.
To study the effects of draconian laws and unlawful use of the State’s machinery and force by the enforcement agencies.
To prepare case studies on the rising custodial deaths, killings in encounters, and related issues for ensuring that human rights education must address the need of evolving new structures of knowledge and accountability to impart new skills and sensitivities amongst holders of State power so as to make them more responsive to the culture of human rights and values of democracy.
To necessitate human rights education to evolve strategies and schemes for talking such attitudes like employing bonded labour, practicing untouchability, perpetrating sati, and helping members internalize a more humane and egalitarian approach in their social relations.
To help stop legal social and economic discrimination against women and their exploitation in different ways.
To promote human rights education as a catalyst in bringing out attitudinal and social change among the management of fireworks, glass, stone crushing, and related industries for reducing the prevalence of child labour in these and other hazardous industries to zero.
To create an environment and an understanding that human rights can quickly become vulnerable to abuse of various structures and processes of power.
To ensure comprehensiveness and incorporation of national, regional, and international perspectives related to human rights.
To study the philosophical and cultural basis and historical perspectives on human rights.
To examine the interdependence of and linkages between human rights and democracy, pluralism, development, ecological balance, peace, and harmony at the national and international levels.
To study the texts, treaties, arrangements, and structures innovated by the international community in the post-world war period for the protection of human rights, the effect of the cold war on the status and functioning of various institutions and structures organized for the promotion and protection of human rights.
Strengthen law enforcement — including federal, state, and local drug task forces — to combat drug-related violence, disrupt criminal organizations, and arrest and prosecute the leaders of illegal drug syndicates.
Improve the ability of High-Intensity Drug Trafficking Areas (HIDTA) to counter drug trafficking.
Help law enforcement to disrupt money laundering and seize and forfeit criminal assets
Break the cycle of drug abuse and crime.
To develop a more distinctive and effective role for the International Court of Justice in the field of human rights.
To work jointly and severally in making India a corrupt-free country. The society will work as a Non-political organization in different fields. In the present scenario, society will motivate ordinary people in various fields like state unity, state population, Law and Justice, Environment, Pollution, art and music, literature, human rights, health, and family welfare, etc.
To conduct research, workshops, seminars, and other knowledge collection activities on crime, corruption, child, dory, and governance issues and to disseminate their results among academia and organizations of the field.
To establish a crime control cell at every block where people discuss their problems, and we can help them with the coordination of local police.
Protect and promote human rights by monitoring, investigation, intelligence advocacy, and taking solidarity actions.
To study and prepare reports on the violation of human rights by the State and its agencies, the police and the criminal justice system inconsistent with human rights norms.
To suggest action for violation of rights by armed political groups and terrorists.
Promote appropriate legal and administrative reforms, particularly judicial and police reforms.
• Your donations are completed gifts and are not refundable.
• You or any related third party will not receive any commercial benefit from the donation.
• You do not directly or indirectly control who will be the ultimate beneficiary of the donation.
• You have imposed no conditions or restrictions preventing the Helpful Foundation from using the contribution to further its charitable mission and comply with any remote legal and regulatory requirements.
• You may have advisory privileges on the distribution of money, but you grant the donor samiti exclusive legal control and ownership of your contribution, and accordingly, samiti will be the final and sole authority to decide whether to make further grants to any organization of their choice.
• You authorize the samiti to contact you in relation to your donation, if necessary
• The entirety of your donation is tax-deductible according to the full extent of the law, and you will be issued a receipt for that amount. In addition to the terms of this Agreement, You must agree to the terms of the terms provided below.
a. Indemnification; Disclaimer; Limitations on Liability. Indemnification. You shall defend, indemnify and hold samiti and its Affiliates, and their officers, employees and representatives, harmless from and against any and all awards, liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees) incurred in connection with allegations, claims, demands, suits or proceedings made or brought against samiti arising out of or related to (i) Use of your donation in a manner consistent with the Agreement, and/or (ii) Your negligence or willful misconduct. IN NO EVENT SHALL the samiti HAVE ANY LIABILITY TO YOU OR TO OTHER PARTY FOR ANY LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, OR FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL OR SPECIAL DAMAGES OR LOST PROFITS HOWEVER CAUSED arising out of your donation to the samiti Force Majeure. SAMITI shall be excused from the performance of its obligations under the Agreement if such a failure to perform results from compliance with any act of God, fire, strike, embargo, terrorist attack, war, insurrection or riot, computer, telecommunications, service provider or hosting facility failures or delays involving hardware, software or power systems not within Helpful Foundation’s possession or reasonable control, denial of service attacks, incompatibility of Your equipment, hardware or software with the Services, acts or omissions of vendors or suppliers, transportation and telecommunications difficulties, or other causes beyond the reasonable control; provided that such non-performing party immediately notifies the other party of the failure and undertakes all commercially reasonable efforts to resume performance as soon as possible after the occurrence of the force majeure event. Any delay resulting from any of such causes shall extend performance accordingly or excuse performance, in whole or in part, as may be reasonable under the circumstances. Governing Law; Jurisdiction; Venue; Severability of Provisions. The laws of the state of Uttar Pradesh, India, govern this Agreement. Any legal proceedings arising from or relating to this Agreement shall be brought exclusively in the courts located in Greater Noida. The parties hereby consent to the personal jurisdiction and venue of such courts. All parts of this Agreement apply to the maximum extent permitted by law. The parties agree that if any provision of this Agreement is found by a court of competent jurisdiction to be unenforceable as written, then that part will be replaced with terms that most closely match the intent of the unenforceable provision to the extent permitted by law.
